Domestic courts have attained prominent status in the international human rights system. While adjudicating individual claims and interpreting legal provisions, domestic courts have conveyed meanings that are integral to the working of the international human rights system. The dynamism of domestic courts is an undeniable quality, through which they incorporate diverse perspectives based on principles linked to individual sovereignty, justice, peace, etc. In this paper, the role of the Indian Supreme Court has been discussed in light of three landmark decisions (...) where the court applies international and domestic human rights standards to substantiate its interpretations. In light of the cases of Navtej Singh v. Union of India, Joseph Shine v. Union of India, and KS Puttaswamy v. Union of India, the paper examines the approach of the court under five broad headings: (a) the domestic context, (b) autonomy and determination, (c) constitutional parameters and validity of laws (d) vulnerability, and (e) other courts and other contexts. We live in a period of enormous contradictions, so well reflected in social life as well as in legal discourse. A pluralistic society as diverse as India in this age of globalization is a challenge to both the lawmakers and the courts, with new problems emerging in new avatars with alarming consistency. In the last six decades or so, Constitutional democracy has witnessed some of the unprecedented upheavals both in the social and political life of the nation as well as (...) in the arena of life. Laws have been enacted to deal with emerging problems. Courts have been innovative, and exemplary as regards their judicial courage and craft to uphold rule of law and democracy in a country of billion hopes and aspirations. The present book is an ensemble of contributions from young legal scholars from some of the major legal institutions of India. The idea of natural law has a long history. It has had different meanings for different people and continues to occupy intellectual engagements as to the connotations of the expression ‘natural law’ in diverse and different contexts. This requires delving deep into the hoarypast and analyzing the gradual development of the idea of natural law through the ages. Understanding natural law necessitates exploring its relation with positive law, its application, and, notably, the import of the word ‘natural’ in the expression (...) ‘natural law’. Be that as it may, there is no denying the fact that there is an element of exclusivity in natural law that has kept it alive and going across generations. Even some of the jurists who adhered to the principles and tenets of legal positivism have shown an inclination towards the principles of natural law, especially as regards the relation between law and morality. It has survived the tests of time. The present paper seeks to explicate the various dimensions of natural law and explore its growth application. (shrink)

The development of cultural heritage tourism (CHT) frequently encounters obstacles pertaining to community support, as the attitudes of the local populace typically dictate the outcome of tourism endeavors. The community's influence on these perceptions has been undervalued in traditional approaches, which has resulted in low levels of engagement and support for cultural preservation. This study aims to bridge this gap by investigating how different degrees of community involvement impact local perceptions of the advantages of tourism, the preservation of culture, and (...) general satisfaction with the results. Data was gathered from 300 participants who were actively involved in many heritages sites' tourism planning. The connections between perceptions of the advantages of tourism and community involvement (CI) were evaluatedby utilizing Partial Least Squares Structural Equation Modeling (PLS-SEM). The results demonstrated that the perceptions of economic benefits (PEB), perceptions of cultural preservation (PCP), and community satisfaction (CS) are all positively impacted by greater CI. The aforementioned results underscore the significance of adopting participatory methodologies, implying that cultivating community engagement is vital for the sustainable growth of CHT. (shrink)

Speaker recognition under mismatched conditions is a challenging task. Speech signal is nonlinear and nonstationary, and therefore, difficult to analyze under realistic conditions. Also, in real conditions, the nature of the noise present in speech data is not known a priori. In such cases, the performance of speaker identification or speaker verification degrades considerably under realistic conditions. Any SR system uses a voice activity detector as the front-end subsystem of the whole system. The performance of most VADs deteriorates at the (...) front end of the SR task or system under degraded conditions or in realistic conditions where noise plays a major role. Recently, speech data analysis and processing using Norden E. Huang’s empirical mode decomposition combined with Hilbert transform, commonly referred to as Hilbert–Huang transform, has become an emerging trend. EMD is an a posteriori, adaptive, data analysis tool used in time domain that is widely accepted by the research community. Recently, speech data analysis and speech data processing for speech recognition and SR tasks using EMD have been increasing. EMD-based VAD has become an important adaptive subsystem of the SR system that mostly mitigates the effect of mismatch between the training and the testing phase. Recently, we have developed a VAD algorithm using a zero-frequency filter-assisted peaking resonator and EMD. In this article, the efficacy of an EMD-based VAD algorithm is studied at the front end of a text-independent language-independent SI task for the speaker’s data collected in three languages at five different places, such as home, street, laboratory, college campus, and restaurant, under realistic conditions using EDIROL-R09 HR, a 24-bit wav/mp3 recorder. The performance of this proposed SI task is compared against the traditional energy-based VAD in terms of percentage identification rate. In both cases, widely accepted Mel frequency cepstral coefficients are computed by employing frame processing from the extracted voiced speech regions using the respective VAD techniques from the realistic speech utterances, and are used as a feature vector for speaker modeling using popular Gaussian mixture models. The experimental results showed that the proposed SI task with the VAD algorithm using ZFFPR and EMD at its front end performs better than the SI task with short-term energy-based VAD when used at its front end, and is somewhat encouraging. In this paper, we employ bibliometric analysis to empirically analyse the research on social entrepreneurship published between 1996 and 2017. By employing methods of citation analysis, document co-citation analysis, and social network analysis, we analyse 1296 papers containing 74,237 cited references and uncover the structure, or intellectual base, of research on social entrepreneurship. We identify nine distinct clusters of social entrepreneurship research that depict the intellectual structure of the field. The results provide an overall perspective of the social entrepreneurship field, (...) identifying its influential works and analysing scholarly communication between these works. The results further aid in clarifying the overall centrality features of the social entrepreneurship research network. We also examine the integration of ethics into social entrepreneurship literature. We conclude with a discussion on the structure and evolution of the social entrepreneurship field. (shrink)

For close to forty years now T.M. Scanlon has been one of the most important contributors to moral and political philosophy in the Anglo-American world. Through both his writing and his teaching, he has played a central role in shaping the questions with which research in moral and political philosophy now grapples. Reasons and Recognition brings together fourteen new papers on an array of topics from the many areas to which Scanlon has made path-breaking contributions, each of which develops a (...) distinctive and independent position while critically engaging with central themes from Scanlon's own work in the area. Contributors include well-known senior figures in moral and political philosophy as well as important younger scholars whose work is just beginning to gain wider recognition. Taken together, these papers make evident the scope and lasting interest of Scanlon's contributions to moral and political philosophy while contributing to a deeper understanding of the issues addressed in his work. Our senses receive a manifold of sensory signals at any given moment in our daily lives. For a coherent and unified representation of information and precise motor control, our brain needs to temporally bind the signals emanating from a common causal event and segregate others. Traditionally, different mechanisms were proposed for the temporal binding phenomenon in multisensory and motor-sensory contexts. This paper reviews the literature on the temporal binding phenomenon in both multisensory and motor-sensory contexts and suggests future research directions (...) for advancing the field. Moreover, by critically evaluating the recent literature, this paper suggests that common computational principles are responsible for the temporal binding in multisensory and motor-sensory contexts. These computational principles are grounded in the Bayesian framework of uncertainty reduction rooted in the Helmholtzian idea of unconscious causal inference. (shrink)

PurposePossession and usage of data-enabled smartphones have added further complexity to the issue of cyberloafing behavior and it certainly evokes newer ethical concerns. This study aims to explore how working individuals perceive the ethicality of their cyberloafing behaviors at the workplace and the cognitive logics they apply to justify their cyberloafing behavior.Design/methodology/approachIncorporating constructivist grounded theory methodology, 19 working managers from various organizations were interviewed face-to-face and responses were audio-recorded with prior consent. The recordings were transcribed verbatim, simultaneously analyzed and coded (...) to let the themes emerge out of the data.FindingsThe research showed that working managers use varied combinations of office computers, personal laptops, smartphones, wireless internet provided at the office and personal mobile-internet to loaf around at workplaces. Moreover, it unearthed that employees use nine different neutralization techniques and six different ethical logics (with normative undertones) in a network fashion while considering the ethicality of cyberloafing behavior.Practical implicationsRecognizing the complexities is imperative to moderate any deviant behavior in an organization. The layers of ethicality and neutralization tactics will equip the working managers and companies to place the required internet and smartphone usage policies in the future.Originality/valueThis research has taken into account all forms of cyberloafing behaviors. The perceived ethicality of cyberloafing behavior at the workplace was not fully explored in a holistic manner before, specifically in the Indian context. (shrink)

A reasoned argument or tarka is essential for a wholesome vāda that aims at establishing the truth. A strong tarka constitutes of a number of elements including an anumāna based on a valid hetu. Several scholars, such as Dharmakīrti, Vasubandhu and Dignāga, have worked on theories for the establishment of a valid hetu to distinguish it from an invalid one. This paper aims to interpret Dignāga’s hetu-cakra, called the wheel of grounds, from a modern philosophical perspective by deconstructing it into (...) a simple probabilistic mathematical model. The objective is to understand how and why a vāda based on a probabilistically weaker hetu can degrade into a Jalpa or vitaṇḍā. To do so, the paper maps the concept of ‘Bounded Rationality’ onto the hetu-cakra. Bounded Rationality, an idea coined by the management thinker Herbert Simon, is often employed in understanding decision-making processes of rational agents. In the context of this paper, the concept would state that the prativādin and ālocaka (debater) may not hold unbounded information to back their pratijñā (proposition). The paper argues that within the probabilistically deconstructed hetu-cakra model, most people argue in the ‘Zone of Bounded Rationality’, and thus, the probability of a debate degrading into Jalpa or vitaṇḍā is high. -/- . COVID-19 has had a huge impact on workers and workplaces across the world while putting regular work practices into disarray. Apart from the obvious effects of COVID-19, the pandemic is anticipated to have a variety of social–psychological, health-related, and economic implications for individuals at work. Despite extensive research on psychological contracts and knowledge sharing, these domains of pedagogic endeavor have received relatively little attention in the context of employee creativity subjected to the boundary conditions of the organization’s socialization and work-related (...) curiosity. This study investigates, empirically, the role of psychological contracts in escalating employee creativity through knowledge sharing by considering the moderating role of an organization’s socialization and work-related curiosity. The response received from 372 employees of the manufacturing sector has been investigated and analyzed through Smart PLS software. The results have revealed that knowledge sharing is mediating the relationship between psychological contract and employee creative performance, whereas the moderators significantly moderate the relationships between psychological contract and knowledge sharing and between knowledge sharing and employee creative performance accordingly. It has also been depicted that the moderating impact shown by both moderators is significantly high. (shrink)

_Swaraj_ has a prominent place in modern India's socio-political imagination. Its multiple interpretations by the leaders and organisations, often on the opposite spectrum of political ideologies, have shaped the nation's socio-cultural, political, and economic thinking and intellectual life. This paper examines the Gandhian conception of s_waraj_ by comparing it with other equally important concepts in Gandhian lexicons of politics, such as truth, nonviolence, _satyagraha_, and _sarvodaya_. It underlines the significance of the socio-economic conception of _swaraj_, which Gandhi expressed through constructive (...) programmes. The second part of this paper examines its re/interpretations by the two prominent socialist leaders – Jayaprakash Narayan (1902-1979), popularly known as JP, and Rammanohar Lohia (1910-1967). They were founding members of the Congress Socialist Party (CSP), formed in 1934. Although inspired by Mahatma Gandhi's (1869-1948) leadership and programme, JP and Lohia were, at one point, ideologically opposed to Gandhian ideals and methods. However, in their distinct ways, both re/interpreted the Gandhian conception of _swaraj_ in post-independence India for the 'reconstruction' of its polity and society. (shrink)

The most predominant kind of disease that is normal among ladies is breast cancer. It is one of the significant reasons among ladies, regardless of huge endeavors to stay away from it through screening developers. An automatic detection system for disease helps doctors to identify and provide accurate results, thereby minimizing the death rate. Computer-aided diagnosis has minimum intervention of humans and produces more accurate results than humans. It will be a difficult and long task that depends on the expertise (...) of pathologists. Deep learning methods proved to give better outcomes when correlated with ML and extricate the best highlights of the images. The main objective of this paper is to propose a deep learning technique in combination with a convolution neural network and long short-term memory with a random forest algorithm to diagnose breast cancer. Here, CNN is used for feature extraction, and LSTM is used for extracted feature detection. The experimental results show that the proposed system accomplishes 100% of accuracy, a sensitivity of 99%, recall of 99%, and an F1-score of 98% compared to other traditional models. As the system achieved correct results, it can help doctors to investigate breast cancer easily. (shrink)

Personal values act as guiding principles that motivate individuals and influence their lifestyle decisions, especially altruistic and egoistic values in green consumption decisions. Sustainable consumption is always portrayed as pro-social behavior showcasing the volunteering activity (altruism) of green consumers; however, consumers buy green products beyond altruistic reasons. Building on these lines, this study aims to examine green consumers and their motivation to pay a premium price for green packaging. This descriptive study has collected opinions related to the constructs from 264 (...) millennials across India to test the hypotheses. The results show that both altruistic and egoistic values explain consumers’ intentions to consume green packaging. In addition, bearing a green identity promotes green packaging preferences for all individuals with altruistic or egoistic values. The moderating role of willingness to pay a premium had a negative effect on the egoistic value and green packaging preference relationship, indicating that green values do not persuade egoistic value consumers to adopt green packaging. This study is one of the very few to examine preferences for green packaging for reasons other than safeguarding the environment. This study contributes to the literature by developing and testing theoretical links to various cognitive variables (altruistic and egoistic values) of green packaging preferences empirically. Asia’s pharmaceutical sector has experienced remarkable growth over the last two decades, with companies in the region producing bulk of the world’s specialty generics, biologicals, and active pharmaceutical ingredients (APIs). The Asian pharma growth story has had several pillars for a strong and sustainable foundation that provided non-linear growth. This report introduces three models showing how Asian countries at different development stages — India, South Korea, and Singapore — have nurtured their own, self-sustaining pharmaceutical sectors.

In several experiments of survival analysis, the cause of death or failure of any subject may be characterized by more than one cause. Since the cause of failure may be dependent or independent, in this work, we discuss the competing risk lifetime model under progressive type-II censored where the removal follows a binomial distribution. We consider the Akshaya lifetime failure model under independent causes and the number of subjects removed at every failure time when the removal follows the binomial distribution (...) with known parameters. The classical and Bayesian approaches are used to account for the point and interval estimation procedures for parameters and parametric functions. The Bayes estimate is obtained by using the Markov Chain Monte Carlo method under symmetric and asymmetric loss functions. We apply the Metropolis–Hasting algorithm to generate MCMC samples from the posterior density function. A simulated data set is applied to diagnose the performance of the two techniques applied here. The data represented the survival times of mice kept in a conventional germ-free environment, all of which were exposed to a fixed dose of radiation at the age of 5 to 6 weeks, which was used as a practice for the model discussed. There are 3 causes of death. In group 1, we considered thymic lymphoma to be the first cause and other causes to be the second. On the base of mice data, the survival mean time of mice of the second cause is higher than the first cause. (shrink)

Purpose Previous studies on cyberloafing have so far not focused on the interlinkages among push factors, pull factors, consequences of actions and value orientations of the employees in a comprehensive manner. The purpose of this study is to close that gap by integrating push-pull theory with means-end chain framework. Design/methodology/approach Using a soft-laddering technique, semi-structured interviews were conducted with 21 Indian employees from various organizations with prior written consent. After performing the content analysis and preparation of ladders, an implication matrix (...) and a hierarchical value map were constructed using the LadderUX tool. Findings “Upholding conversational conformity,” “achieving efficiency through noise cancellation,” “addressing occasional requirements,” “social networking as a coping mechanism,” “staying informed and sharing opinions,” “attempting job or profile alteration” and “fulfilling transactional obligations” turned out to be the seven prominent means-end chain patterns, with their respective push-pull factors, consequences and value orientations. This study also suggested the multifaceted character of cyberloafing in a continuum, from “serious-destructive” to “minor-positive” to “facilitative-productive.” Research limitations/implications This study has been conducted by focusing on cyberloafing at physical workplaces and not in the context of distributed work environments. Practical implications The findings of this study will enable organizations to frame an appropriate set of guidelines to control this behavior. Originality/value To the best of the authors’ knowledge, this study is the first to integrate the push-pull theory and means-end chain framework to explore the nuances of cyberloafing among employees. Humans are moral creatures. Among all life on Earth, we alone experience rich moral emotions, follow complex rules governing how we treat one another, and engage in moral dialogue. But how did human morality evolve? And can humans become morally evolved? -/- In A Better Ape, Victor Kumar and Richmond Campbell draw on the latest research in the biological and social sciences to explain the key role that morality has played in human evolution. They explore the moral traits that (...) humans share with chimpanzees; how a more complex moral mind enabled Homo sapiens to arise and out-compete other human species; and the place of morality alongside historic revolutions in technology and social organization. Throughout the book, Kumar and Campbell argue that morality co-evolved with intelligence and complex sociality. Morality prevents societal collapse and enables complex knowledge. -/- After unearthing the ancient origins of human morality, Kumar and Campbell use evolutionary theory to deliver profound insights about how to advance moral progress and resist moral regress, such as reducing animal suffering on industrial farms; capitalizing on the recent revolution in gay rights to foster a nascent revolution in transgender rights; opposing intersectional inequality that impacts women and people of color in lower socioeconomic classes; and addressing major problems of global inequality, especially impending crises of injustice caused by anthropogenic climate change. Entrepreneurship is important in economic growth and development. This study explores the likelihood that societal-level well-being and country-level self-expression values positively influence individual entrepreneurship across countries. Self-expression values mediate and reinforce the effect of societal well-being on entrepreneurship. Well-being is not simply an individual-level expression of positive emotions or an individual’s accumulated human capital alone. It is also a country’s stock of psychological as well as social resource and a macrolevel culture-specific emotion supporting entrepreneurship. This study provides a multidimensional approach (...) to exploring the effects of societal well-being and country-level self-expression values on entrepreneurship. The proposed conceptual model uses three theoretical propositions to delineate an indirect effect of societal well-being mediated through country-level self-expression values. The study also compiles measures of societal well-being terms from secondary data sets for use in cross-country comparative empirical research into entrepreneurship. (shrink)

This paper examines the problem of sameness in terms of being it the classical problem of personal identity and various philosophical positions on the existence of the self as a substantive subject. I call this subject an ethical Self, which involves different notions of ego, being, substance, and personhood. The denial of the existence of a permanent self by philosophers like Hume and Buddhists does not seem justified in regard to one's identity or sameness over time. The no-self theorists do (...) not provide any strong ground for how to explain the notion of personhood and one's actions in a moral space without accepting a substantive self as a doer that continues over time. They certainly seem to have failed in establishing a logical connection between their no-self theories on the one hand and the necessity of an ethical self in their philosophical accounts on the other. Rejecting the no-self theory in defense of the self theory of personal identity, I conclude this paper with a note that sameness of a person over time is the prerequisite of morality, law, and present and future plans and that there is no harm in considering a permanent self, as Jīva of Jainism, to solve the problem of personal identity. There is also no harm in preferring the self theory over the no-self theory since the former, unlike the latter, does give a meaning to spirituality and transcendence. (shrink)

Gandhi’s writings on moral issues propose an easiest formula to the world to establish harmony and peace in the global society. In a world where people are confronting a psychological fear of sudden terror and violence, the Gandhian formula of ‘non-violence (ahimsa) as a means’ to form a perfect harmonious world is getting strong attention of the world-community. Truth and non-violence are the two most valuable ingredients of Gandhian moral thoughts. For him, Truth or God is the end and non-violence (...) is the mean and the two can not be separated. They are more effective in life when they are used in their united form. This unity can be actualized only through the motive of ‘love to humanity’ without separating one person from another on any ground. He argues that the unity of truth and non-violence is a better way to have a moral and harmonious life. In this paper, I will focus upon the Gandhian formula in wider perspective, which reflects in his political activities and his writings as well, with the contention that it is highly applicable to normalize the violence rooted in different parts of the world at both the levels of religious and political. I will contend that Gandhian notion of truth and non-violence in terms of ends and means may play a medicinal role to harmonize the world suffering from extremism and terrorism. (shrink)

The horror of 7/7 and the radicalization of young British Muslims have prompted a flurry of obituaries gleefully chronicling the demise of multiculturalism. This article turns the clock back to revisit Bhikhu Parekh's Rethinking Multiculturalism, the scholarly cousin of the report by the Runnymede Commission on The Future of Multi-ethnic Britain, both published in 2000. It argues that multiculturalism has never been as universally acceptable as recent critiques would lead us to believe, but also that philosophical multiculturalism (of which Parekh's (...) is totemic) is the unfortunate victim of a lazy conflation with political multiculturalism. While Parekh's multiculturalism is worryingly sympathetic to the prevailing management of cultural diversity, it also illuminates the orthodox Left's elective disengagement with questions of culture, ethnicity and religion. Recent events have brought home the message that neglecting the complexity of belonging only strengthens the impulse for sectarian collectivism. They awaken us to the fact that Britain's emerging political actors will be multiculturalism's children: citizens who refract their interests through the lens of their inherited cultures. The question is whether we constitute the fact of cultural diversity as a full stop, as Parekh does, or whether we creatively seize it to enable `multicultures' of social justice, as this article advocates.
